Key Immigration Policy in Arizona

In 2010, Arizona Governor Jan Brewer signed one of the nation’s toughest immigration policies into law: Senate Bill 1070: the Support Our Law Enforcement and Safe Neighborhoods Act. Its goal was to prevent unlawful immigration. The original bill allowed local police to check immigration status based on “reasonable suspicion” and to enforce immigration policies across the state.  

However, after challenges from immigration rights organizations, a 2012 Supreme Court ruling significantly whittled down the law’s provisions. For example, it is no longer a criminal offense for individuals to lack federal immigration papers or to accept work without authorization. Also, officers can no longer arrest individuals without a warrant, even if they believe they are deportable immigrants.  

The court ruling leaves it to the officer’s discretion to determine “reasonable suspicion.” Further, ethnicity or language is not a valid reason for inquiry, but officers still have the right to demand papers if they see fit.
