Understanding the Naples Immigration Landscape

Importance of Legal Representation

While it is possible to apply for an immigration visa on your own, it is wise to hire a Naples immigration lawyer to represent you. Immigration law is complicated. Any errors on forms or failure to submit the proper documentation can seriously affect your application.

The immigration process can take months or years even if all information is submitted correctly. Any mistakes or omissions can further set your immigration case back.

We will explain all of the requirements for obtaining a visa or Green Card to our clients to make sure that you understand every step of the process. If your application has been rejected, we will file an appeal on your behalf.

How an Immigration Lawyer Can Help in Naples

A Naples immigration lawyer will ensure that all of your forms for the U.S. Customs and Immigration Service (USCIS) are filled out correctly before submission and that the required documentation is included.

Based on your individual situation, we can determine the best visa path for you to pursue. That may involve family-based immigration or employment immigration. Either category can eventually lead to a coveted Green Card and citizenship.

Citizenship and Naturalization Process

Those born in the U.S. are automatically citizens. If you were born abroad but at least one of your parents was a U.S. citizen, you are likely already a U.S. citizen. There are other circumstances in which you may already prove a U.S. citizen, such as adoption by a parent who is a U.S. citizen.

Other applicants for citizenship must go through the naturalization process.

Eligibility Criteria for Citizenship

To become a naturalized U.S. citizen, you must meet the following criteria:

  • You must be at least 18 years of age.
  • You must be a permanent resident for at least five years or three years if married to a U.S. citizen.
  • Complete and submit Form N-400, Application for Naturalization.
  • Get fingerprinted and photographed at a biometrics appointment for a USCIS background check. In some instances, previous fingerprints and photos may be used.
  • Schedule an interview and report to the USCIS office at the appointed time.

During the USCIS interview, you will answer questions regarding your Form N-400. Most applicants must take English and civics tests.

In many cases, the officer conducting the interview will decide to approve your Form N-400 on that day. In some situations, additional information and another interview may be required.

Keep in mind that if you fail the English or civics tests, you are retested only on the failed test. A second failed grade means that your Form N-400 is denied.

Legal Updates and Changes in Immigration Policies

In January 2024, the USCIS announced the streamlining of H-1B petitions. The H-1B program allows employers to hire nonimmigrant aliens as workers in specialty occupations.
