Understanding Immigration Law in Houston

Texas is home to one of the harshest anti-immigrant laws in the nation. In 2023, Texas lawmakers approved Senate Bill 4 (SB 4), which allows police to arrest individuals for illegally crossing the Texas-Mexico border. This controversial law makes crossing the Rio Grande a Class B misdemeanor, punishable by up to six months in jail. Those charged with illegal reentry could face even more jail time.

Mired in controversy, a federal appeals court blocked SB 4 ahead of a hearing brought by immigration advocates. Opponents, including the Department of Justice, believe the law infringes on the federal government’s authority over immigration and could lead to racial profiling.

SB 4’s status currently remains in limbo. If it’s ultimately enforced, other states may be encouraged to file similar laws, creating more hurdles for those seeking to live, work, and travel in the U.S. safely and legally. This battle illustrates the tense legal and political climate immigrants face in Houston and across Texas.
